Terms of Service

Property Scroll is operated by Cascade Buildtech Pvt. Ltd. (“Property Scroll”, “we”, “us” or “our”), a company incorporated in India, at propertyscroll.in. These Terms of Service, together with our Privacy Policy, form a binding agreement between you and us. If you do not agree with any part of these terms, please do not use the platform.

You must be at least 18 years old and able to enter into a legally binding contract under Indian law to use Property Scroll. If you use the platform on behalf of a business (for example as a builder or channel partner), you confirm you are authorised to bind that business to these terms.

Property Scroll is a discovery and information platform that helps buyers and investors find property across India and connect with the builders and channel partners who list it. We provide the technology and presentation layer; we are not a party to any transaction, agreement to sell, lease or investment that you enter into with a seller.

We are not a real-estate broker, agent, dealer or investment adviser, and we do not act on your behalf in any transaction. Any decision to buy, sell, lease or invest is made solely between you and the relevant counterparty, and you are responsible for conducting your own due diligence and taking independent legal, financial and tax advice.

Listing content, including prices, availability, specifications, images, RERA details, approvals and locality information, is supplied by the builders and channel partners who publish it. While we verify the sellers we onboard and hold listings to an editorial standard, we do not independently guarantee that every detail is accurate, current or complete.

Listings are for general information and do not constitute an offer or a binding representation. Prices and availability can change without notice. You should verify all material facts, including title, approvals, RERA registration, carpet area, charges and possession timelines, directly with the seller and through your own advisers before committing to any transaction.

Property Scroll does not promise that a listing will result in a transaction, that a seller will respond, or that any property will deliver a particular return, appreciation or rental yield. Any forward-looking or investment-related statement on the platform is indicative only and is not a guarantee. We charge buyers nothing to browse or enquire, and we do not earn a brokerage on your dealings with a seller.

You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorised use. When using the platform you agree not to:

• Post false, misleading, fraudulent or infringing listings or content, or impersonate any person or entity.
• Scrape, harvest, copy or redistribute listings or platform data by automated means without our written permission.
• Interfere with, probe or attempt to gain unauthorised access to the platform, its security or other users' accounts.
• Use the platform to send spam, harass other users, or for any unlawful, harmful or unauthorised commercial purpose.
• Upload malicious code or anything that violates applicable law or the rights of others.

We may suspend or terminate access that breaches these terms or that we reasonably believe harms the platform or its users.

The Property Scroll name, logo, platform, software, design, text and other materials we create are owned by Cascade Buildtech Pvt. Ltd. or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the platform for its intended purpose. You may not copy, modify, distribute, sell or create derivative works from our materials without our permission.

Content you submit (such as listings) remains yours, but you grant us a worldwide, royalty-free licence to host, display, adapt for presentation and promote that content on and in connection with the platform. You confirm you have the rights necessary to grant that licence.

The platform may reference or link to third-party sites, tools or services, including home-loan and financing partners. We do not control and are not responsible for their content, products or practices, and your use of them is governed by their own terms. A reference is not an endorsement.

The platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the platform will be uninterrupted, error-free or secure, or that listing information is accurate or complete.

To the maximum extent permitted by law, Property Scroll and Cascade Buildtech Pvt. Ltd. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, opportunity, data or goodwill, arising from your use of, or inability to use, the platform or from any dealing with a seller. Our total aggregate liability for any claim relating to the platform will not exceed the greater of the amount you paid us in the twelve months before the claim or one thousand rupees.

You agree to indemnify and hold harmless Property Scroll, Cascade Buildtech Pvt. Ltd. and our officers, employees and partners from any claim, loss, liability or expense (including reasonable legal fees) arising out of your use of the platform, your content, or your breach of these terms or of any applicable law or third-party right.

These terms are governed by the laws of India. Subject to any right you have under applicable consumer law, the courts at Chandigarh, India, will have exclusive jurisdiction over any dispute arising out of or relating to these terms or your use of the platform. We encourage you to contact us first so we can try to resolve any concern amicably.

We may update these terms from time to time. When we make material changes we will revise the “Last updated” date above and, where appropriate, notify you.
